What is our rights against Windows 10?

I have various systems at home & a large number of systems running windows 7 at work. I, my work colleagues & family are in a constant battle with Microsoft to stop windows 10 from not only downloading but installing.

My son has a laptop that does not work or even support windows 10. I have tested this myself as he asked me to upgrade for him & it just refused to work. But he has had his laptop automatically upgrade without him "apparently" doing anything other than shutting down his system with updates ready to be installed.

So far I am aware of the following.

1. KB 2952664- a secret snooping patch first pushed to Windows 7 back in April.

2. KB 2976978 – last issued in June, it is a scanner which sends diagnostics to Microsoft from CEIP participants.

3. KB 2977759 – another diagnostic scanner, this one analyses computers to see whether their hardware is compatible for upgrades to Windows 10 and sends the data to Microsoft.

4. KB 3035583 – this patch contains the infamous ‘Get Windows 10’ nagware pop-up which anyone who hasn’t upgraded to Windows 10 will likely have disabled by now. Well Microsoft thinks you need reminding, because now it has been reclassified as ‘Important’ and will therefore install automatically. So prepare for those Get Windows 10 pop-ups to start appearing again.

Windows 10 Upgrade Pressure Is Excessive < STOP IT

In fact these four re-releases come just one month after Microsoft formally admitted it has started automatically downloading the full Windows 10 upgrade (over 3GB) onto all Windows 7 and Windows 8 computers – even for users who specifically stated they do not want to upgrade.

So basically my question is. What is our rights as not only a Business user but a home user to stop Microsoft pushing a unwanted OS onto our hardware?

We own our current windows & are 100% happy with it. We should have a choice in deciding to upgrade or not. We should also have a choice in allowing what is downloaded onto our hardware that is in no way owned or part owned by Microsoft.

I'm pretty sure Microsoft are breaching our rights in some fashion because they can't manipulate our updates to trick us into downloading content we thing is important when in fact its the windows 10 upgrade. This has led to my company & my home systems disabling windows update feature as this is the only way to stop Microsoft pushing this OS onto our systems & by doing so is putting our systems at risk.

So if any legal heads can suggest where Microsoft is breaching our rights because in no way in the windows 7 TOS or license does it state that Microsoft has the right at any time to upgrade or replace our OS with another of their choice!
